By installing or using Hexpendi, you agree to these terms. If you do not agree, please do not use the app.

Who we are

Hexpendi is built and operated by an individual developer based in Lithuania. Contact: support@hexpendi.com.

The service

Hexpendi is a GPS-based exploration app that records your walks and reveals hexagonal tiles on a map as you move. The app and the website at hexpendi.com are provided free of charge for personal, non-commercial use.

You may use Hexpendi if you are at least 13 years old (or older where required by local law).

Walk safely - your responsibility

Hexpendi requires you to walk outdoors. You are solely responsible for your own safety while using the app:

Stay aware of your surroundings - watch for traffic, cyclists, obstacles, and uneven terrain.
Do not stare at your phone while walking. Lock the screen, put the phone in your pocket, and let the app track in the background.
Do not enter private property, restricted military zones, construction sites, or any unsafe location to reveal hexes.
Obey all local laws, signs, and posted restrictions.
Use common sense regarding weather, lighting, your physical condition, and personal safety.
Do not use the app while operating a vehicle.

To the maximum extent permitted by law, we are not responsible for injuries, accidents, property damage, trespassing claims, or losses of any kind that occur while you use the app.

Acceptable use

You agree not to:

Spoof your GPS location, use a mock-location app, or otherwise fake your position to reveal hexes or unlock achievements you did not earn by walking.
Reverse-engineer, decompile, disassemble, or modify the app, except where such restrictions are prohibited by applicable law.
Use the app for any illegal purpose, including stalking, harassment, or surveillance of others.
Attempt to disrupt, overload, or abuse our region-lookup service, our website, or any infrastructure we operate.
Attempt to extract data from other users (the app has no concept of "other users" - this is a precaution).
Resell, sublicense, or redistribute the app or its content.

We may suspend access to our region-lookup service from any IP, device, or installation that we believe is engaged in abuse.

Battery and mobile data

GPS tracking uses battery and may use mobile data for map tile downloads and region lookups. You are responsible for any data charges from your carrier. Typical usage is under 5 MB per hour of active walking.

Accuracy disclaimer

GPS accuracy depends on your device, weather, surroundings, satellite availability, and many factors outside our control. Map data and administrative region boundaries come from OpenStreetMap, which is volunteer-maintained and may be incomplete or out of date. Hexpendi makes no guarantees about positional accuracy, region-boundary correctness, achievement timing, or distance calculations.

Your data

How we handle your data is described in our Privacy Policy. In short: your walking history stays on your device. We collect only anonymous analytics and (if you opt in) anonymous crash reports.

Intellectual property

The Hexpendi app, the Hexpendi name, and the Hexpendi logo are owned by us. You receive a personal, non-exclusive, non-transferable, revocable license to use the app for its intended purpose. All other rights are reserved.

Map data is licensed from OpenStreetMap contributors under the Open Database License (ODbL). Your walks, your hex grid, and your achievements belong to you.

Third-party services

The app uses third-party services (Google Firebase, Cloudflare, OpenStreetMap, Nominatim) listed in detail in our Privacy Policy. Your use of those services is also governed by their respective terms. We are not responsible for the availability, content, or actions of those services.

Beta and changes

Hexpendi is currently in beta and under active development. Features may change, be added, or be removed without notice. We may update the app, change features, change pricing (currently free), or change these terms at any time. Continued use of the app after a change indicates acceptance of the change.

Termination

You can stop using Hexpendi at any time by uninstalling the app. Your locally-stored data is deleted when you uninstall or clear app data. We may terminate or suspend your access to our region-lookup service at any time, with or without cause, particularly in cases of suspected abuse.

No warranty

The app is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not promise the app will be error-free, available at all times, free of bugs, or fit for any particular purpose.

Limitation of liability

To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to the app or these terms is limited to ten euros (€10) or the amount you have paid us in the past twelve months, whichever is greater. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you. In that case, our liability is limited to the maximum extent permitted by applicable law.

Governing law and disputes

These terms are governed by the laws of the Republic of Lithuania, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms or the app will be resolved in the courts of Lithuania.

If you are a consumer based in the EU, you also retain any mandatory rights provided by the consumer protection laws of your country of residence, and any disputes may also be referred to the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

Severability

If any provision of these terms is found unenforceable, the rest remains in effect. The unenforceable provision will be replaced with an enforceable provision that most closely matches the intent of the original.
